The objective of the UNIDROIT principles was to summarize rule and practices relating to contracts that are common amongst the majority of legal systems across the globe in order to achieve harmonization. In this process, it has given more body to the Lex Mercatoria which throughout time has been criticized for being too vague and never giving a clear indication as to its contents. The UNIDROIT principles have also in the process proposed innovative solutions to satisfy the requirements of modern international trade. As such, the UNIDROIT Principles act as the framework or guideline within whose ambit international commercial contracts should be governed. Therefore, the UNIDROIT Principle will apply both in situations where parties have agreed to be governed by them as terms of the ir contract or in instances where parties agree for the contract to be governed by the general principles of the Lex Mercatoria. The PECL too has a similar history to that of the UNIDROIT principles and was first published in 1995. The PECL was published with the primary objective of making all EU public contracts bound by the PECL. It further provided for private parties also to expressly refer to and be bound by the PECL when entering into contracts. The application of the two principles is very similar in nature, despite the fact that the UNIDROIT principles apply international commercial contracts whereas the PECL applies to all types of contracts within the European Community. One other significant difference between the two is that the UNIDROIT Principles are applicable only for business to business (B2B) transactions whereas the PECL is applicable to business to consumer (B2C) transactions as well. Thus, as stated at the inception, unlike the CISG the UNIDROIT princi ples and the PECL are not legally operative instruments. Meaning they function more as soft law in comparison to the CISG which functions as hard law. As such, the PECL and UNIDROIT principles cannot be considered to be the governing laws of a contract, but rather can be incorporated into the terms of a contract. Moreover, when it comes to arbitration proceedings which function lex arbitri and parties are given the choice of selecting à ¢Ã¢â€š ¬Ã‹Å"rules of lawà ¢Ã¢â€š ¬Ã¢â€ž ¢ which do not necessarily form part of a national legal system an arbitration tribunal will be allowed to surpass domestic mandatory rules. Article 1:201 of the PECL requires that parties act in accordance with good faith and fair dealing. Thus fraud and taking of unfair advantage have been stated as grounds for voiding a contract in order to ensure that parties act in good faith both prior to entering into the contract and throughout the performance up until the conclusion of the contract. This includes good faith during negotiations and even goes to the extent of not disclosing confidential information. Good faith in the PECL is considered a mandatory rule and goes a step further to qualify termination of a contract for trivial breach as contrary to good faith even though in reality it could be considered technically as non performance. The Catcher in the Rye The Catcher in the Rye - foreshadowing - The use of forshadowing in a novel can help it's reader get a sense of what is to come in the story without giving away the events themselves. It is a powerful tool which prevents events from being left unexplained, leaving the reader question the effectivness of an outcome. The eventual breakdown of the character Holden Caufield in J.D. Salinger's controversial 1945 novel "The Catcher in the Rye" was foreshadowed in the early chapters of the book. The first clue is his negative approach to life. He begins by talking about his "lousy childhood" (p.1) and the first traces of profanity can be seen scattered about the page in the form of "crap", "hell" and "goddam". Holden's first sign of distrust comes when he speaks to Ward Stradlater about his date with Jane Gallagher: "Listen. Give my regards, willya?" "Okay," Stradlater said, but I knew he probably wouldn't... "A sk her if she still keeps all her kings in the back row." "Okay," Stradlater said, but I knew he wouldn't. (p.33-34) This is seen again when he doesn't trust Stradlater to stop his advances of Jane in the case that she says no. Holden gives up his faith in people to trust him when he boards a bus holding a snowball. The driver refuses to believe that Holden won't throw the snowball so he draws the conclusion that "People never believe you." (p.37). He is also always placing labels upon people as being "phonies" which gives the reader the idea that Holden thinks that others are materialistic. Holdens attempts to protect the innocence in the world is another early sign of his deteriorating state. When Holden goes to Pheobe's school to deliver his note he sees some swearing of the wall which he says "drove me damn near crazy" (p.201). He wipes the words from the wall in an attempt to prevent the inevitable from occuring, leading the reader to believe that he m ay experience some mental unstability in the future. Eventually he comes to the realization that he can't rub all the profanity away himself. Another example of Holden's attempt to shelter innocence is the fact that he never does call Jane, possibly for fear that she will scar his memories of her as an innocent child. The title of this novel presents this theme to the reader in that Holden wants to be "the catcher in the rye" (p. ) so he can catch all of the children that sway to close to the edge of a cliff in thier play. Perhaps the most obvious example of foreshadowing in the novel occurs when his parents come close to having him "phsycoanalyzed and all" (p.39) when he breaks all the windows in the garage. Throughout the novel he refers to himself as "a madman" (p.79) which gives the reader the idea that he sees himself as having a sort of mental problem. These two peices of evidence alone present a fairly firm idea of what will happen to Holden towards the end of the story. The use of foreshadowing is evident in the novel "The Catcher in the Rye". It does it's job well in that it foretells the outcome of Holdens many problems and gives reason for it. The eventual breakdown of Holden is not startling to the reader because of the authors use of foreshadowing and therefore it is effective.

The Anti-Placebo Effect? In my last web paper I struggled with the idea that Melatonin is supposed to make people sleepy. If anything I became more restless. Well, what is that all about? So, in this paper, I decided that I wanted to find out, what that was "about". If you pull it apart, you can tell that it has something to do with the preconceived ideas that we have running around in our heads. So then, I thought, well, that is the placebo effect right? If you think that something, such as a drug or supplement, is supposed to perform a certain way, then even if it is nothing more than a sugar pill some people will have a larger tendency to play out that reaction. This is not a conscious choice. From the little neurobiology background I have, I would venture a guess to say that the preconceived notion of what is supposed to happen acts a triggering signal that would create an change in the membrane permeability of the neuron. And that would in turn cause an action potential and be the beginning of some sort of effect. So to dissect it with my previous example, if we were, theoretically, under the assumption that these Melatonin supplements truly had no effect. The population at large would, through the media and other advertising schemes, be made to believe that this drug supplement would induce sleep. Therefore that notion would lead to changes in the nervous system that were brought about by these beliefs causing a placebo effect. But the heart of my question here is that does this idea work in the other direction? My hypothesis previous to my beginning my research was yes. Not only because the Melatonin did not work for me and family, but because of what we have been discussing in class. My Philosophy of Life

My philosophy of life Is quite simple. When I was younger, I would always be more focused on the things that people had. I would look at my other cousins, and since the parents had better jobs than my mom, they would have nicer clothes, or the newest v died games before I did all the time. This would make me feel really self conscious through hoot my childhood, not necessarily because I was worried about not getting as much as they would. I would be spending all my money on concerts, and would never have anything concur et to tangibly have with my money, and my cousins would still have all these nice possess ones they could hold onto. I had the experiences that they didn't, but they were Just embedded in my mind, and they could physically touch and use theirs, it didn't seem fair. When I had decided to move to Florida to visit my step dad for a few months before moving to Boston to go to Emerson College, that was when my perspective changed. Ever drove or walked pass a homeless shelter and wondered how so many people got there? According to the American Aid Foundation, â€Å"Seven out of 10 Americans are one paycheck away from being homeless.† Getting a paycheck every two weeks does not mean a person cannot become homeless. Many would think only drug abuse and being poor are the reasons for homeless. There are many other ways to become homeless and for some people it becomes permanent. Many people that are homeless are single with kind, had/have welfare and do not have much work experience. The children are so youth that they develop emotional and mental problems. Drug and alcohol abuse become greater once people become homeless. Poverty is when there is not enough money for support. If people do not have enough money for their needs, they will need to do cutbacks. Once they start cutting back, they get behind on bills and either get evicted or have to foreclose. They are plenty of homeless individuals that are still employed. Yet they are homeless because they do not make enough to be financially stable. Even though some people may be unemployment, they should still have government programs to be stable. For example, they programs like Welfare reform, food stamps, unemployment checks, and housing assistance. These are programs made in order to support those with no jobs. With the many cutbacks on the budget that the government has, people cannot be stable enough on their own. With rents continuing to rise, there will be a greater deficit on af fordable housing.
